Last week Andrew Bulley and Alexander Vial from 5 Wentworth delivered presentations for the Law Society of NSW Specialist Accreditation Week for commercial litigation.
Andrew presented on the topic of the Presumptions of Resulting Trust and Advancement; how they arise and how they interact with each other together with an examination of a recent NSW Court of Appeal decision in the area: Metcalf v. Zhang [2020] NSWCA 228.
Alexander presented on the topic of Outlines of Evidence in the Federal Court and discussed changing judicial attitudes to affidavit evidence and the emerging preference for oral evidence in chief, especially where the evidence to be given is on a critical, contentious, or complex issue.
